Why Should You Care about Regulations like HIPAA and SOX?

Remember the good old days when the most a storage administrator had to worry about was whether the backups worked last night? While this is still worth thinking about, today it might be the least of your worries. The increase in electronic document storage over the past 20 years has led to a wave of new legislation addressing requirements for electronic document retention. As organizations store more and more of their valuable documents and communications in electronic formats, new laws have been created to address, for example, what types of documents must be kept, for how long, and in what formats.

The Health Insurance Portability and Accountability Act (also known as Kassebaum-Kennedy) of 1996 and the Sarbanes-Oxley (SOX) Bill of 2002 are two of the most well-known information privacy acts. These are Federal laws that require every company that keeps medical records or financial information to ensure the privacy and correctness of those records.

These are not the only laws that apply; there are many more such laws in the United States and throughout the rest of the world that not only specify how sensitive data must be used and stored, but that also impose serious penalties for those who are not in compliance.

One major impact of these and other recent laws regarding information privacy is that you and the senior executives in your company are now personally responsible for what happens with the personal data that you store. If your company’s security is breached and sensitive information is compromised, you and the people who run your company are subject to criminal penalties that can include jail time. The consequences of failing to pay attention to information privacy are significant: Now, not only can you lose your job, but you can lose your family and your freedom as well.
